Commento all'art 17 (divieto dell'abuso di diritto)

The present paper deals with the notion of abuse of right in the field of human rights. Such a notion is used in the frame of the European Convenition on Human Rights, with a deep analysis of the Strasbourg organs case law on art. 17 ECHR. The focus of the paper is the changing role of the abuse of right in such a case law.

L'articolo esamina il contributo della Corte europea dei diritti umani ai processi di transizione democratica con particolare attenzione ai Paesi dell'Est europeo. Dall'analisi della giurisprudenza della Corte non emerge una visione unitaria del concetto di "transizione democratica", che viene in rilievo talvolta come un fatto, altre volte come un valore. La stessa "transizione - valore", poi, non è concepita in temini unitari, dato che la democrazia può essere intesa come "aperta" o come "militante". Il contributo si propone, pertanto, di comprendere se nella giurisprudenza della Corte sia possibile riscontrare, se non altro, la ricerca di un punto di equilibrio tra queste diverse nozioni.

Deliberative democracy and the European Convention on Human Rights Theories of deliberative democracy have rapidly become very popular amongst political scientists.
